- L’elaborato propone una serie di riflessioni sull’esercizio effettivo dell’azione penale, in relazione al contesto organizzativo delle procure della Repubblica. Il potere di esercitare l’azione non è inteso nel limitato significato tecnico di formalizzazione dell’accusa, ma include altresì le attività che precedono quel momento e che, nel loro insieme, esprimono la funzione inquirente del pubblico ministero: organizzare, dirigere, gestire, condurre le inchieste giudiziarie. Sussiste uno iato tra il piano formale dell’organizzazione del pubblico ministero e gli aspetti pratici dell’esercizio dell’azione penale, così come esiste un distacco fra il principio e la realtà dell’azione penale stessa. Sotto la dimensione applicativa del principio di obbligatorietà, dunque, si discute di specializzazione investigativa e di criteri di priorità nell’esercizio dell’azione penale, al fine di evitare sistematiche violazioni del dettato costituzionale per mezzo di esercizi arbitrari dei poteri discrezionali.
- This paper offers a series of thoughts on the effectiveness of the prosecution in criminal proceedings, in relation to the organisational context of the public prosecutors' offices. For this purpose, prosecution should not be intended as filing the accusation in itself, but much more widely it includes the activities that precede that moment and which express the investigative function of the public prosecutor: to organise, direct, manage, conduct judicial investigations. There is a difference between the structural features of the prosecutors’ office and the prosecution, as well as a gap between the mandatory principle and the reality of the prosecution itself. Therefore, due to the problems raised by the compulsory prosecution, the specialisation and the priority criteria in the preliminary investigations are proposed in order to avoid systematic violations of the constitutional rights through the exercise of prosecutorial discretion.
