The author critically analyzes the first static results of the negotiation agreements drawn up by the National Forensic Council, to suggest new strands of socio-juridical research able to enhance the emerging phenomenon of "forensic jurisdiction" and to make the role of lawyers understand as specialized legal actors able to direct the private legal systems, to which the ADR belong, towards the acquisition of more democratic and equitable characteristics. Such studies are also useful for guiding the choices of the Legislature that in our country seems to be trying to change procedural models developed abroad (such as the French participatory procedure, the Canadian delegated arbitration and more generally the US Collaborative Law) without a prior analysis of the conditions that can make these institutions more consistent with the national legal culture and more effective their impact on society.Key words: Negotiation, Altarnative Dispute Resolution, civil procedure

L’autore analizza criticamente le prime risultanze statiche degli accordi di negoziazione elaborati a cura del Consiglio Nazionale Forense, per suggerire nuovi filoni di ricerca socio-giuridica in grado di valorizzare il fenomeno emergente della “giurisdizione forense” e di far comprendere il ruolo degli avvocati quali attori giuridici specializzati in grado di indirizzare i sistemi giuridici privati, a cui le ADR appartengono, verso l’acquisizione di caratteri più democratici ed equi. Simili studi sono, inoltre, utili per orientare le scelte del Legislatore che nel nostro Paese pare tentato di mutuare modelli procedimentali elaborati all’estero (come la procédure partecipative francese, l’arbitrato delegato canadese ed più in generale il Collaborative Law statunitense) senza una previa analisi delle condizioni che possano rendere tali istituti più coerenti con la cultura giuridica nazionale e più efficace il loro impatto sulla società.Parole chiave: Negoziazione, Altarnative Dispute Resolution, Processo civile.
